लेकिन अगर कोई legitimate professional promise किया गया है, तो उसे casually “मैंने तो ऐसे ही बोल दिया था” कहकर ignore करना अलग सवाल खड़ा कर सकता है।

Delhi में matrimonial, maintenance, divorce, property या family disputes में ऐसी बातें कभी-कभी बहुत छोटी लगती हैं—लेकिन बाद में यही communication dispute का हिस्सा बन सकती है।

पत्नी ने divorce proceedings के दौरान Section 24 Hindu Marriage Act के तहत interim maintenance मांगी थी। Family Court ने ₹5,000 per month maintenance January 2021 से देने का direction दिया था।

पति ने Delhi High Court में challenge किया।

लेकिन Court ने पति की हर बात accept नहीं की।

पति ने अपनी income ₹16,500 per month बताई थी, जबकि Family Court ने उसकी monthly income ₹22,000 assess की थी। High Court ने इस assessment में interference नहीं किया क्योंकि पति की lower income को establish करने के लिए केवल अपने पिता द्वारा जारी salary certificate पर्याप्त credible supporting evidence नहीं था।

यह हिस्सा husbands के लिए बहुत important है:

Maintenance case में केवल यह कहना कि “मेरी income कम है” काफी नहीं हो सकता। अपने income position को documents से properly establish करना पड़ता है।

लेकिन दूसरी तरफ पति की appeal में एक महत्वपूर्ण point स्वीकार हुआ।

Record में यह सामने आया कि wife Bata showroom में काम कर रही थी और लगभग ₹7,000 per month earn कर रही थी। वह January 2021 में maintenance application file करते समय employed थी और June 2024 तक काम करती रही।

इसलिए Delhi High Court ने कहा कि उस employment period के लिए उसे Section 24 HMA की interim maintenance नहीं मिलनी चाहिए।

Family Court का ₹5,000 monthly direction modify हुआ और maintenance 1 July 2024 से, यानी उसके unemployed होने के बाद, payable की गई।

अब इसे अपने situation से जोड़कर समझिए।

इस judgment में भी High Court ने पति की income कम करने की plea को अलग तरीके से देखा और पत्नी की actual employment को अलग तरीके से। इसलिए Delhi maintenance case में husband को अपनी income और wife की actual earning—दोनों sides का documentary record carefully examine करना चाहिए।

और एक बात बिल्कुल ignore मत कीजिए।

अगर Family Court ने maintenance order pass कर दिया है, तो यह मान लेना कि “बाद में देखेंगे” financially dangerous हो सकता है। Order की date, maintenance period, wife's employment period, husband's income evidence और supporting documents को तुरंत examine करना चाहिए।
